The Bucharest Court of Appeal decided to remove several pieces of evidence from the case in which Călin Georgescu, Horațiu Potra, his son and grandson, as well as other close people are accused of actions against the constitutional order and non-compliance with the weapons and ammunition regime.

The court’s decision particularly concerns the statements given as witnesses by several close relatives of Horațiu Potra. These statements were made in December 2024, shortly after the first arrests in this case.

According to the information appearing in the public space, the magistrates of the Bucharest Court of Appeal decided that these evidences cannot be used in the trial, being considered illegally obtained.

At the same time, the court rejected as unfounded the requests and exceptions formulated by Călin Georgescu and Horațiu Potra.

Statements removed from file

Among the people whose statements were removed from the file are Ioan Lup, Manfred-Ioan Haptman, Cristian Sergiu Borisca, Adrian Inocentiu Comiza, Vasile Dragoman, Traian Lechințan, Ovidiu Mureșan, Dan-Cristian Panța, Constantin Timofti, Claudiu-Marian Lăpădatu, Matei Dărăbanț, Iulian Aniței, Mihail-Alex Goloșoiu, Marius-Samuel Apahidean, Daniel Szanto, Dionisie Moldovan and Bogdan Lascu.

The prosecutors initially used these statements to highlight the contradictions in the explanations given by those interviewed regarding their travel to Bucharest.

According to the indictment, some of those interviewed claimed that they came to the Capital to have fun in the Old Center, to go to a football match or to pick up a package or a diploma.

Also from these statements emerged the role attributed to Horațiu Potra in organizing the trip, the prosecutors claiming that he would have been the central figure in the logistical coordination and in the group’s strategy.

What the law provides

The Criminal Procedure Code states that illegally obtained evidence cannot be used in criminal proceedings.

Also, the law provides that the statement given by a person as a witness cannot be used against him if, later, in the same case, he acquires the status of suspect or defendant.

What triggered the investigation

The file is related to a trip organized on the night of December 7 to 8, 2024, when Horațiu Potra allegedly gathered a group of 21 people who left Mediaș for Bucharest.

According to the prosecutors, the move would have been related to a possible destabilizing action.

However, the group never reached the capital, being stopped in traffic by the police before entering Bucharest.
